1. Introduction

These Terms of Service (“Terms”) form a binding agreement between SurveyMate Ltd (“SurveyMate”, “we”, “us”), a company incorporated in England and Wales (Company No. 17144402), and the individual or organisation (“you”, “Customer”) accessing or using the SurveyMate platform. By creating an account or clicking “Create Account” you accept these Terms in full.

2. Eligibility and accounts

You must be at least 18 years old and have legal capacity to enter contracts in your jurisdiction. If you register on behalf of a company, you warrant that you are authorised to bind that company to these Terms.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@damp-survey.com if you suspect unauthorised access.

3. Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose or in breach of any applicable law or regulation.
  • Upload content that infringes third-party intellectual property rights.
  • Attempt to gain unauthorised access to any part of the platform or its infrastructure.
  • Reverse engineer, decompile, or extract source code from the platform.
  • Resell, sublicense, or otherwise commercially exploit the platform without our prior written consent.
  • Introduce malware, viruses, or any other harmful code.
  • Use automated scraping or data harvesting tools against the platform.

4. Subscriptions and billing

Access to paid features requires an active subscription. Subscriptions are billed in advance on a monthly or annual cycle as selected at checkout. All payments are processed by Stripe, Inc. and are subject to Stripe’s terms.

Free trials. Where offered, free trials automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; no refunds are issued for unused time except where required by law.

Price changes. We will give you at least 30 days’ written notice before any price increase. Continued use after the notice period constitutes acceptance of the new price.

Failed payments. If a payment fails we will attempt retry. After 7 days of non-payment we reserve the right to suspend access to paid features.

5. Intellectual property

SurveyMate and its licensors own all intellectual property rights in the platform, including software, design, trademarks, and documentation. These Terms do not transfer any ownership to you.

You retain ownership of all data and content you upload to the platform (“Customer Data”). You grant us a limited, non-exclusive licence to store, process, and display Customer Data solely for the purpose of providing the platform to you.

6. Anonymised data

We may generate anonymised, aggregated insights from Customer Data (e.g. regional prevalence statistics for damp and mould). Such insights contain no personally identifiable information and no property-level data that could identify any individual or specific property. We may use, publish, or commercialise these insights without restriction and without obligation to you.

7. Professional responsibility

SurveyMate is a software tool to assist professional surveyors. It does not provide surveying advice. All survey findings, recommendations, and reports are the sole professional responsibility of the licensed surveyor producing them. SurveyMate accepts no liability for any advice, opinion, or recommendation contained in a report generated using the platform.

8. Limitation of liability

To the maximum extent permitted by law, SurveyMate’s total aggregate liability to you in connection with these Terms (whether in contract, tort, or otherwise) shall not exceed the greater of (a) the fees you paid to us in the 12 months immediately preceding the claim, or (b) £100.

We shall not be liable for any indirect, consequential, special, or punitive loss, including loss of profits, loss of data, or loss of goodwill, even if advised of the possibility of such loss.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

9. Availability and changes

We aim for high availability but do not guarantee uninterrupted access. We may carry out maintenance, updates, or modifications to the platform at any time. We will use reasonable endeavours to give advance notice of planned downtime.

We may modify these Terms at any time by posting an updated version on our website and notifying you by email. Continued use after the effective date of changes constitutes acceptance. If you do not agree, you may cancel your subscription before the changes take effect.

10. Termination

We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees when due, or if we are required to do so by law. On termination you may request an export of your Customer Data within 30 days; after that period data may be deleted in accordance with our retention schedule.

11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
